Welcome to http://www.shs.io and https://app.shs.io (the “Websites”), which is operated by Students Helping Students (“SHS”, “we”, or “us”).

SHS is a charitable, tax-exempt, nonprofit corporation that provides school supplies, including books, classroom materials, sports equipment, musical instruments, furnishings, and other supplies or aid, to students in school districts impacted by natural and other disasters or otherwise in need.

SHS is committed to maintaining your confidence and trust. We have adopted the following Privacy Policy (this “Policy”) to explain our practices relating to information we collect and information you provide to us. By accessing the Website, by submitting information to us (“Information”), or by participating in SHS’ activities, you agree to comply with and be bound by this Policy, which includes and incorporates all the provisions in the SHS Terms of Use and all applicable federal, state, and local laws and regulations.

1. When does this Policy apply?

SHS is fortunate to work with many individual volunteers, schools, and other charitable partners; the term “you” or “your” refers to any participant in SHS and any user or viewer of the Website, who may include, without limitation: a donor to SHS, an individual submitting a volunteer profile on the Website, a tax-exempt school that has executed a School Club Participation Agreement with SHS and is submitting a school profile to receive donations or offer volunteer opportunities on the Website (each a “School Club”), and an individual authorized to submit a volunteer profile or school profile on behalf of an individual or a School Club.

This Policy does not apply to websites or services offered by any other individual or entity, including any school or business (each a “Third Party”), even when you heard about such Third Party from us or where this Website provides a link to such Third Party’s website. Information that you provide to a Third Party is provided directly to such Third Party, subject to their policies, if any, even if accessed or identified through the Website. SHS is not responsible for the content of policies, or the privacy and security practices, of any Third Party.

We review this policy regularly, and make changes in connection with its review. Please check this privacy policy page periodically for changes. Your use of the Website or submission of any Information following the posting of changes to this Policy means that you have accepted those changes.

2. What Information does SHS collect?

When using the Website or submitting hard copy papers to SHS, including by volunteering, signing up for communications, making a charitable gift, or requesting assistance (collectively, “Participation in SHS”), we may request Information from you to facilitate your Participation in SHS. This Information may include certain personally identifiable information (“PII”) such as your:

a. contact information including email address, name, home and/or work address, and/or telephone number;
b. credit card or other payment account information for donations made through the Website, which may be maintained in encrypted form on secure servers;
c. anonymous demographic information, which is not unique to you, such as your zip code, age, gender, preferences, and interests; and
d. information about your computer hardware and software that is automatically collected by SHS, such as your IP address, browser and/or device type, the features of the apps you use, access times, and the web pages or sites that you visit just before or just after you use the Website.

SHS does not generally collect sensitive PII, such as race, religion, or political affiliations.

Since your Participation in SHS is completely voluntary, you, therefore, have a choice whether to disclose any Information, including your PII.

3. How does SHS collect Information?

We collect Information you submit through the Website and on SHS forms and in your interactions with SHS’ staff or representatives.

The Website also uses “cookies”, which are small pieces of information that are stored by your browser on your computer’s hard drive to collect Information that includes standard internet log information and visitor behavior in an anonymous format, which help us personalize your Website experience. The “cookie” can be accessed by the Website upon your return visit.

4. How does SHS use and maintain Information?

We use your Information for our activities including: to facilitate charitable gifts of supplies to schools in need, to provide you services, to personalize information that we provide to you, to send you communications, to conduct surveys about your experiences with SHS, and for our other fundraising and everyday business and charitable purposes. We may contact you from time to time at the email, phone, fax, or mailing address on file with us regarding your Participation in SHS.

We use the credit/debit card information that you provide when making a donation on the Website only to handle and complete that donation. We do not share this credit/debit card information with third parties except as necessary to handle and complete your donation. We do not retain this credit/debit card information in SHS’ files.

SHS is committed to data security. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of Information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the Information. SHS follows generally accepted industry standards to protect the information that you submit to SHS, both during transmission and once SHS receives it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive, therefore, to use commercially acceptable means to protect the Information, we cannot guarantee its absolute security.

5. How does SHS share Information?

SHS seeks to connect schools in need with charitable resources, including donors. SHS, therefore, provides your contact information to other users on the Website.

SHS often describes the accomplishments of selected School Clubs on the Website. Each School Club, therefore, expressly grants SHS permission to use the school’s name in SHS fundraising materials.

SHS may share your Information with one or more Third Parties:

a. to introduce you to another charity or school for potential charitable collaborations, including gifts of supplies to schools or students in need;
b. to further our charitable purposes, including by fundraising and in strategic planning to fulfill our charitable mission;
c. for such Third Party to provide Website, application development, hosting, maintenance, data analysis, or other services;
d. for such Third Party’s direct marketing purposes; and
e. when legally required, such as under a subpoena, court order, bankruptcy action, or other legal process, or to cooperate with law enforcement or other governmental officials.

6. How can you affect our collection of Information and our further communications with you?

Participation in SHS is voluntary, and you may decline to submit Information to us, although we may not be able to provide a full range of services to you without full Information. You also have the ability to accept or decline cookies that collect your Information by adjusting the settings of the web browsers on your device to modify your cookie settings.

You can access, edit, or delete Information contained in your SHS Website profile at: [Website address]. If you delete all of your Information, you will no longer be able to access the Website.

It may take us up to 10 business days to process an opt-out request, during which time your Information may be included on lists we provide to a Third Party.

8. What additional terms apply to this Policy?

Compliance with Law and Charitable Intent

You agree to use this Website only as allowed by SHS and in compliance with all applicable federal, state, and local laws and regulations. You represent for the benefit of SHS that all Information is complete, accurate, and truthful.

Indemnification and Limitation of Liability

You agree to hold harmless, defend, and indemnify SHS and all SHS’ employees, representatives, directors, officers, agents, including volunteers, and affiliated persons (each an “Indemnified Party”) against all claims, damages, losses, liabilities, costs, and expenses (including, without limitation, settlement costs and any reasonable legal, accounting, or other expenses for investigating or defending any actions or threatened actions) (collectively “Losses”) incurred by such Indemnified Party to the extent that such Losses are due to your gross negligence, willful misconduct, fraud, or breach of this Policy.

IN NO EVENT SHALL SHS BE LIABLE FOR ANY CLAIM FOR ANY INDIRECT, WILLFUL, PUNITIVE, INCIDENTAL, EXEMPLARY, SPECIAL OR CONSEQUENTIAL DAMAGES, FOR LOSS OF BUSINESS PROFITS, OR DAMAGES FROM LOSS OF BUSINESS ARISING OUT OF THIS POLICY, OR FOR LOSS OR INACCURACY OF DATA OF ANY KIND, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF SHS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. You agree that SHS shall not be liable to you for any modification, suspension, or discontinuance of the Website.

Children and Privacy

We believe in the importance of protecting the privacy of children online. The Website is not intended to solicit, and we do not knowingly collect, Information of any kind from, or on, children under the age of 13 years.

The Children’s Online Privacy Protection Act (“COPPA”) governs information gathered online from or about children under the age of 13. Verifiable consent from a child’s parent or guardian is required before collecting, using, or disclosing personal information from a child under age 13. Changes and Updates to this Policy

SHS may amend this Policy at any time in SHS’ sole discretion. You agree that SHS may notify you about such changes by posting them on the Website and/or by email to you.

Related Legal Documents

This Policy is part of and incorporated into SHS’ Terms of Use, which is the contract between you and SHS governing use of the Website. For any school or School Club, this Policy also incorporates by reference such School Club’s applicable School Club Participation Agreement.
